This license does not include any commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents. The Service is not available to minors under the age of 18 or to any users suspended or removed from the system by InsiderTrips for any reason. Users may not have more than one active account. Users found creating fake accounts to benefit from our referral program will be banned from the site indefinitely. In consideration of your use of the Site, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. Separate terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. Please read these separate terms and conditions carefully. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of fares, products, or services. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier's rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.
Please be aware that by submitting content to this Website by electronic mail, postings on this Website or otherwise, including any hotel reviews, questions, comments, suggestions, ideas, trip ideas or the like contained in any submissions (collectively, "Submissions"), you grant InsiderTrips.com and its affiliates, a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised; and (b) use the name that you submit in connection with such Submission. You acknowledge that InsiderTrips may choose to provide attribution of your comments or reviews (for example, listing your name and hometown on a hotel review that you submit) at our discretion, and that such submissions may be shared with our supplier partners. You further grant Insider Trips the right to pursue at law any person or entity that violates your or Insider Trips rights in the Submissions by a breach of this Agreement. You acknowledge and agree that Submissions are non-confidential and non-proprietary. We take no responsibility and assume no liability for any Submissions posted or submitted by you. We have no obligation to post your comments; we reserve the right in our absolute discretion to determine which comments are published on the InsiderTrips.com website. If you do not agree to these terms and conditions, please do not provide us with any Submissions.
You are fully responsible for the content of your Submissions, (specifically including, but not limited to, reviews posted to this Website). You are prohibited from posting or transmitting to or from this Website: (i) any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material or content that would violate rights of publicity and/or privacy or that would violate any law; (ii) any commercial material or content (including, but not limited to, solicitation of funds, advertising, or marketing of any good or services); and (iii) any material or content that infringes, misappropriates or violates any copyright, trademark, patent right or other proprietary right of any third party. You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this Website. You acknowledge that Insider Trips may exercise its rights (e.g. use, publish, delete) to any content you submit without notice to you.
1. The Process:
By placing an order for a given Trip, you make an offer to purchase the Trip you have selected on the terms, restrictions and conditions associated with the specific trip listed on the Insider Trips website. Once you've placed theorder, you will receive a confirmation of the Deal and your credit card will be charged for the amount of the Trip. We will notify you by email when the Trip Certificate (defined below) for the Trip is ready to be used. You must create an account in order to purchase any Trip from Insider Trips An account is required so we can collect information to allow you to pay for your Trips and allow you with access to print your Trips, view past purchases, and modify an of your personal information.
2. The Trip Certificate (aka Voucher)
Each Trip combines two separate portions that make up the Deal: (i) a paid portion equal to the amount your credit card is charged and similar to a paid gift certificate (the "paid portion"); and (ii) at no additional charge to you, a promotional portion for the balance of the value of the Deal if used by the promotional expiration date on the Voucher (the "promotional portion") (together, the paid and promotional portions of the Deal are presented in a "Voucher"). In the event you redeem your Voucher for less than the full amount stated on the Voucher, your purchase will be allocated first against the paid portion until it has a balance of zero dollars ($0.00) and then against the promotional portion that is remaining.
3. Expiration Dates
The expiration date for a Voucher is as printed on the Voucher.
If the expiration of the paid value of the Voucher as of the date printed on the Voucher is prohibited under the law of the jurisdiction in which the Merchant is located, then the Voucher shall expire as follows: the promotional portion of the Voucher will expire on the date printed on the Voucher, and the paid portion of the Voucher will expire five (5) years from the date the Voucher is issued, except to the extent applicable law requires that the Merchant extend the period in which the Voucher may be redeemed. The Merchant is obligated to honor the Voucher in compliance with law. If the Merchant refuses to honor the Voucher before the legally permitted expiration date, then Insider Trips will refund the paid portion of your Voucher in the form of a credit for future Deals (what we currently call "trip bucks"). In order to receive the credit, you must provide the following information in writing to info@insidertrips.com: (a) identification of the Voucher and Merchant with whom you sought to redeem the Voucher, (b) statement of the date, time, and circumstances in which the Merchant refused to redeem the Voucher, and (c) a statement, under penalty of perjury, that the Voucher has never been redeemed with the Merchant.
4. Trip Bucks
"Trip Bucks" are a form of Insider Trips currency that may be applied as a credit towards future Insider Trips purchases. Trip Bucks are not returnable or refundable for cash, except where required by law. Resale of Trip Bucks is strictly prohibited.
5. Deal Specific Terms
Each Trip has specific terms associated with the Deal, which will be presented to you at the time you commit to purchase the particular Deal. Deal specific terms supersede any inconsistent terms in this Agreement, except to the extent such terms are prohibited by applicable law.

7. Merchant Responsibility
To be clear, Insider Trips markets the Deals and acts an as agent in selling the Vouchers on behalf of the Merchants. But the Merchant is the issuer of the Voucher. As issuer of the Voucher, the Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Merchant or its products and services, as well as for any unclaimed property liability arising from unredeemed or partially redeemed Vouchers. By purchasing a Deal, a customer acquires the right to print a Voucher issued by the participating Merchant and to use the Voucher according to its terms and the terms of this Agreement. Whether you choose to print and/or redeem the Voucher is within your sole control and at your sole discretion.
8. Refunds
Insider Trips will provide a refund of the purchase price paid by you for any Deal within 24 hours after the purchase of a Voucher, provided that the Voucher has not yet been redeemed. After 24 hours, we do not provide refunds except that we will provide a refund if you are unable to redeem a Voucher before the applicable expiration of the Voucher because the relevant Merchant has gone out of business.
Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. Insider Trips urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac and www.customs.gov.

If, despite the limitation above, InsiderTrips or its suppliers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liabilityof InsiderTrips or its suppliers will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to InsiderTrips in connection with such transaction(s) on this Site, or (b) One-Hundred Dollars (US$100.00) or the equivalent in local currency.
The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of InsiderTrips and its suppliers.
You agree to indemnify and hold InsiderTrips (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including reasonable attorneys' fees, or arising out of or related to your breach of this TOS, your violation of any law or the rights of a third party, or your use of the Site.
When you use the Site or send emails to InsiderTrips, you are communicating with InsiderTrips electronically. You consent to receive communications from InsiderTrips electronically. InsiderTrips will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
We welcome expressions of interest in employment with InsiderTrips. InsiderTrips does not discriminate in hiring or employment on the basis of race, color, religion, disability, national origin, age, sex, or any other characteristic protected by applicable federal, state or local law. You understand that the invitation to submit your resume or expression of interest in a job posted on the Site is not intended to, and does not, create a contract between you and InsiderTrips for employment or for any other benefit. Notwithstanding the above, InsiderTrips may from time to time monitor the Postings on the Site and may decline to accept and/or remove any email or Postings. You understand and agree not to use any functionality provided by the Site to post content or initiate communications that contain:
(i) Any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law; (ii) Advertisements or solicitations of any kind; (iii) Impersonate others or provide any kind of false information; (iv) Personal information such as messages which state phone numbers, social security numbers, account numbers, addresses, or employer references.; (v) Messages by non-spokesperson employees of InsiderTrips purporting to speak on behalf of InsiderTrips or containing confidential information or expressing opinions concerning InsiderTrips; (vi) Messages that offer unauthorized downloads of any copyrighted or private information; (vii) Multiple messages placed within individual folders by the same user restating the same point; (viii) Chain letters of any kind; or (ix) Identical (or substantially similar) messages to multiple recipients advertising any product or service, expressing a political or other similar message, or any other type of unsolicited commercial message. This prohibition includes but is not limited to a) Using InsiderTrips.com invitations to send messages to people who don't know you or who are unlikely to recognize you as a known contact; b) Using InsiderTrips.com to connect to people who don't know you and then sending unsolicited promotional messages to those direct connections without their permission; and c) Sending messages to distribution lists, newsgroup aliases, or group aliases.

The Site or third parties may provide links to other World Wide Web sites or resources. Because InsiderTrips has no control over such sites and resources, you acknowledge and agree that InsiderTrips is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that InsiderTrips shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
Access to and use of password protected and/or secure areas of the Site is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Site may be subject to prosecution.
InsiderTrips reserves the right to make changes to the Site, related policies and agreements, this TOS and the Privacy Policy at any time. If InsiderTrips makes a material modification to this TOS, it will notify you by:
(i) sending an email to the address associated with your account. InsiderTrips is not responsible for your failure to receive an email due to the actions of your ISP or any email filtering service; therefore, you should add InsiderTrips.com to the list of domains approved to send you email (commonly known as your "whitelist"); and (ii) displaying a prominent announcement above the text of this TOS or the Privacy Policy, as appropriate, for thirty (30) days, with (i) and (ii) being deemed sufficient notification, of such changes.
After notice of a modification to the TOS or the Privacy Policy has been posted for 30 days, the notice will be removed and a brief description of the modification and the date that it went into effect will be placed in the Historical Modifications section at the end of the TOS and Privacy Policy.
